Preamble

Used4Fans is an online marketplace operated by U4F Marketplace GmbH (“U4F”) that enables eligible sellers (“STARS”) to list and sell specific lawful tangible goods they own to buyers (“FANS”). Items may have a higher subjective value because of their provenance, prior ownership, history or association with the STAR. Unless expressly stated otherwise, U4F provides the marketplace and related support services but is not the seller or buyer of the listed goods. The purchase contract for an item is concluded between the applicable STAR and FAN. Payment services are provided by Stripe or another payment provider designated by U4F, subject to the provider’s terms and eligibility requirements.

Definitions

For these Terms: “Article” or “Item” means a specific tangible good listed for sale by a STAR. “Catalog Rules” means U4F’s rules governing permitted and prohibited items, listing content and conduct, including these Terms and any published policy incorporated by reference. “FAN” or “Buyer” means a registered user purchasing an Item. “STAR” or “Seller” means a registered user approved to list Items. “User” means a STAR or FAN. “Stripe” means the Stripe entity that provides payment services for the relevant account/jurisdiction. “Stripe Connected Account” means a Stripe account associated with a STAR through Stripe Connect. “Payment Provider Rules” means Stripe’s applicable agreements, prohibited/restricted business rules and related requirements, as updated from time to time. “U4F” or “Used4Fans” means the platform operated by U4F Marketplace GmbH. Other statutory abbreviations used in these Terms have the meaning given by applicable Austrian/EU law.

Applicability and changes

These Terms govern access to and use of U4F. By registering or using a transaction feature, a User agrees to these Terms, the Privacy Policy, Catalog Rules and any transaction-specific disclosures presented before purchase or sale. Mandatory statutory rights remain unaffected. U4F may amend these Terms where reasonably necessary, including to reflect legal, payment-provider, safety or product changes. Where required by law, U4F will provide advance notice and information about termination rights.

Eligibility to use the platform

Users must be at least 18 years old and legally capable of entering into binding contracts. U4F may support both private and commercial sellers where permitted. Each User must accurately identify their status and comply with the legal obligations that apply to that status. Commercial sellers must satisfy all mandatory consumer-information, withdrawal, conformity, tax and business-law obligations that apply to sales to consumers.

Registration

Registration is required to buy or sell. Users must provide truthful, accurate, current and complete information and keep it updated. U4F may provide sign-in through supported identity/account providers, but social login does not replace any identity or business verification required by U4F, Stripe or law. U4F may conduct risk-based verification, request documents or information, verify public creator/social profiles, and restrict functionality until checks are complete. Users may not register or transact using false identities, forged documents, misleading business descriptions or accounts controlled by another person without authorization.

Listing Rules — general rule

A STAR may list only a specific bona fide tangible good that the STAR lawfully owns or is authorized to sell. The Item, its description, images, provenance claims, price and intended shipment must comply with applicable law, these Terms, the Catalog Rules, carrier requirements and Payment Provider Rules. U4F may apply stricter rules than applicable law where reasonably necessary for safety, fraud prevention or payment-provider compliance.

Listing Rules — prohibited items and conduct

The following may not be listed, sold, purchased, requested or facilitated through U4F:

• (a) illegal goods or services; stolen goods; counterfeit goods; goods that infringe intellectual-property, privacy or personality rights; or goods the seller is not authorized to sell;
• (b) firearms, ammunition, explosives, illegal weapons, regulated self-defense weapons or other weapons prohibited by U4F or applicable payment-provider rules;
• (c) illegal drugs, controlled substances, cannabis products where prohibited, drug paraphernalia, or items primarily marketed for unlawful drug production/use;
• (d) prescription medicines, regulated medical products, unsafe pseudo-pharmaceuticals, and other health products prohibited by U4F or the payment provider;
• (e) tobacco, nicotine products, vaping products or related products prohibited by U4F or the payment provider;
• (f) currency, stored value, gift cards, payment instruments, financial products, money-transfer services, tips, donations, deposits, crowdfunding, loans or transactions that do not correspond to a bona fide listed good;
• (g) gambling, sweepstakes, lotteries, bidding-fee auctions, paid games of chance/skill with prizes, or gambling-related items/services prohibited by the payment provider;
• (h) pornographic or sexually explicit content; adult services; escort, dating, sexual massage, live sexual chat or fetish services; or any Item/listing whose principal presentation or intended transaction is for sexual gratification rather than ordinary ownership of a tangible good;
• (i) bodily fluids, secretions, excretions, human biological material, bathwater or other personal liquids represented as containing or preserving biological material;
• (j) services or promises to wear, use, soil, scent, alter, contaminate or otherwise prepare an Item to a buyer’s personalized intimate, fetish or sexual instructions after the order is placed;
• (k) unwashed or soiled intimate apparel, or intimate apparel marketed by reference to scent, bodily fluids, duration of intimate wear, sexual activity, fetish use or sexual gratification; U4F may prohibit additional intimate-apparel categories entirely;
• (l) nudity, pornographic imagery, sexually explicit imagery, fetish-oriented imagery or sexualized close-ups in listing photos, profile content or messages;
• (m) hateful, extremist, terrorist or violent material; child sexual abuse material; sexual exploitation; content that promotes unlawful violence or discrimination;
• (n) dangerous, toxic, flammable, radioactive, recalled or unlawfully shippable goods;
• (o) counterfeit currency, identity documents, fake references, document-falsification products or services;
• (p) unlawfully traded wildlife products, ivory, protected species, or other products restricted by conservation law;
• (q) alcohol, food/beverages, supplements, cosmetics, electronics, tickets, digital goods, subscriptions, loot-box products, or other categories that U4F designates as prohibited or restricted for legal, safety, logistics or payment-provider reasons;
• (r) any transaction involving a sanctioned/prohibited person or jurisdiction, or any other Item, service or activity prohibited by Stripe or another payment provider used for the transaction.

U4F may publish additional category-specific rules and may reject a listing even if the category is not expressly named above where the listing creates legal, safety, fraud, chargeback or payment-provider risk.

Seller payment onboarding / Stripe Connected Account

A STAR who wishes to receive payment must complete the payment onboarding required by U4F and Stripe. This may include creation or connection of a Stripe Connected Account and acceptance of the applicable Stripe Connected Account Agreement and privacy notices. Stripe may request identity, address, bank-account, tax, business, beneficial-owner or other information and may require document or biometric/selfie verification depending on the account and jurisdiction. Requirements may change over time. U4F does not guarantee that Stripe will approve or continue to support any STAR. A STAR must promptly provide accurate information requested by Stripe or U4F and must not use Stripe for prohibited or undisclosed products, services or business activity.

Authorization concerning Stripe Connected Account data and activity

To the extent permitted by the applicable Stripe integration, the STAR authorizes U4F to access and use Connected Account information necessary to operate the marketplace; to submit or update information provided by the STAR; to create and manage payment-related objects for U4F orders; to instruct or initiate permitted charges, transfers, refunds, reversals, payout timing or other payment activity connected with U4F transactions; and to share Connected Account information with Stripe as required to provide the services, prevent fraud, resolve disputes and comply with law and Payment Provider Rules. U4F will perform only activity reasonably connected to U4F services and the permissions granted by the STAR and Stripe.

Listing Items / listing content

A STAR may list an Item only after completing the required seller onboarding and linking any creator/social profile required by U4F. The STAR must describe the Item truthfully and completely, including material defects, condition, size and provenance. Images and text must be created or lawfully used by the STAR. Provenance photos may show the STAR holding or ordinarily wearing non-intimate clothing only when the image is non-explicit and complies with U4F content rules. Listing content may not sexualize the transaction, imply the sale of access to the STAR, solicit off-platform payment, or promise a service in addition to the specified tangible Item. Commercial sellers must provide all mandatory consumer disclosures before the FAN is bound.

Price and special pricing

The STAR sets the Item price. Shipping charges, applicable platform fees, taxes and other amounts are displayed as required before the relevant party is bound. An Item may be priced above ordinary second-hand market value because a FAN attributes additional provenance, collectible or sentimental value to the STAR’s prior ownership or the Item’s history. U4F does not determine an objective collectible value and does not guarantee resale value. Pricing and marketing must not use false scarcity, fake provenance, deceptive testimonials, guaranteed-return claims or misleading income/reward statements.

License to listing content

By uploading listing or profile content, the User grants U4F a non-exclusive, worldwide, royalty-free license for the duration reasonably necessary to host, reproduce, display, format, moderate, promote and distribute that content in connection with U4F and its marketplace marketing. The User retains ownership of their content and represents that they have all rights needed to grant this license. U4F may preserve copies where required for fraud prevention, disputes, legal obligations or legitimate recordkeeping.

Conclusion of purchase contract

The purchase contract for an Item is between the STAR and the FAN. U4F provides marketplace infrastructure and payment/shipping support but does not become the seller merely by facilitating the transaction. A FAN makes a binding purchase action through the checkout flow; completion of payment authorization/processing and the order confirmation establish the order subject to these Terms, any statutory rights, fraud/compliance review and any cancellation rights expressly provided in the order flow. Commercial sellers remain responsible for mandatory legal information and consumer rights.

Payment

Payments are processed by Stripe or another payment provider made available by U4F. U4F is not a bank, money transmitter or escrow provider and does not offer a standalone service for holding or transferring funds between Users.

For U4F orders, the FAN pays the total amount shown at checkout using an available payment method. Stripe processes the payment under its terms. Depending on the Stripe Connect configuration, U4F may control when an order becomes eligible for transfer/settlement or seller payout, and may instruct refunds, reversals or other permitted payment actions for U4F transactions. Funds may also be delayed, reserved, reversed or restricted by Stripe, a card network, a bank or law.

The STAR is responsible for the payment-processing and platform fees allocated to the STAR as disclosed in the seller flow. The FAN is responsible for amounts shown to the FAN at checkout. Fees may change prospectively.

Stripe is an independent payment-services provider. Stripe’s processing of a transaction does not constitute endorsement of U4F, a STAR, a FAN or an Item. U4F must not and will not represent that Stripe has approved an individual Item unless Stripe expressly states so.

A successful U4F payment does not prevent a later refund, reversal, chargeback, payment dispute, fraud action, sanctions action or other payment-provider remedy.

Shipping and transfer of risk

The STAR must ship the Item within the stated order deadline, use appropriate packaging and provide genuine tracking information. The Item must be lawful to ship and must comply with carrier, customs and destination-country rules. Where customs information is required, the STAR must use an accurate item description and the legally required transaction/customs value and must not understate value or mislabel the nature of the shipment. If the STAR does not ship within the stated deadline, U4F may cancel the order and initiate a refund. Transfer-of-risk rules between STAR and FAN are governed by mandatory applicable law and, where legally permitted, the terms agreed between them; nothing in these Terms removes non-waivable consumer protections.

Complaints, refunds and payment disputes

A FAN may submit an internal U4F complaint during the complaint period shown for the order. The FAN must provide a reasonably detailed description and supporting evidence. U4F may request evidence from either party and may keep the order from becoming payout-eligible while the complaint is under review.

The STAR and FAN may agree to a full refund, partial refund or other lawful resolution. U4F may implement an agreed or policy-based refund/reversal through Stripe where technically and contractually permitted.

If the parties do not agree, U4F may make an internal marketplace determination based on the available evidence for purposes of U4F account standing and any payment action U4F is permitted to initiate. U4F is not a court or arbitrator unless a separate binding arbitration agreement expressly says otherwise.

The internal complaint process does not eliminate or shorten mandatory statutory rights, cardholder chargeback/dispute rights, card-network rights, Stripe rights, fraud remedies or court remedies. A payment issuer, card network or Stripe may reach a result different from U4F’s internal decision, and that external payment decision may control the payment outcome.

Users must cooperate promptly with requests for information concerning refunds, chargebacks, fraud or payment-provider inquiries. U4F may recover amounts from a User where permitted by law and the applicable payment arrangement if the User’s conduct causes a refund, reversal, chargeback, fee, fine or loss.

Reviews

After a completed transaction, U4F may allow Users to submit reviews. Reviews must be truthful, based on a genuine transaction and must not contain unlawful, abusive, defamatory, discriminatory, pornographic or privacy-infringing content. U4F may remove reviews that violate law or policy and may take account action for manipulation, fake reviews or retaliation.

Private messages / communications

U4F does not provide general private chat as part of the marketplace. Any messaging function made available for order support or complaint resolution may be used only for that purpose. Users may not use U4F communications to solicit sexual services, adult content, personalized wear/use requests, tips, donations, peer-to-peer transfers, off-platform payment intended to evade U4F/Stripe controls, harassment or unlawful activity.

Availability / warranty of platform

U4F does not guarantee uninterrupted availability. Maintenance, security actions, capacity changes, third-party outages and technical faults may cause temporary unavailability. Mandatory statutory warranties or liabilities that cannot lawfully be excluded remain unaffected.

Liability / marketplace role

U4F provides marketplace infrastructure and does not guarantee the condition, authenticity, quality or legal conformity of every Item. Users remain responsible for their listings, purchases, legal obligations and evidence. U4F nevertheless may monitor, review, remove or restrict content and accounts to enforce these Terms, protect Users and satisfy payment-provider/legal obligations. Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability arising from U4F’s own mandatory duties. Any contractual limitation of U4F liability applies only to the extent permitted by applicable law and does not limit mandatory consumer rights.

User obligations

Users must:

• (a) provide accurate and complete registration, transaction and verification information and keep it updated;
• (b) use the platform only through accounts they are authorized to control;
• (c) comply with applicable law, these Terms, Catalog Rules and Payment Provider Rules;
• (d) list and purchase only bona fide permitted tangible goods;
• (e) describe Items and provenance accurately and not use counterfeit, copied or misleading content;
• (f) not upload illegal, hateful, violent, extremist, pornographic, sexually explicit or fetish-oriented content;
• (g) not offer or request adult services, custom intimate wearing/use, bodily fluids, bathwater/personal biological liquids, tips, donations or peer-to-peer money transfers;
• (h) not circumvent fees, moderation, payment-provider onboarding, geographic restrictions or sanctions controls;
• (i) not manipulate tracking, refunds, reviews, chargebacks, identity documents or payment credentials;
• (j) keep login credentials secure and notify U4F of unauthorized access;
• (k) cooperate with U4F, Stripe, banks, card networks and authorities where reasonably required for fraud, KYC, sanctions, chargeback, legal or compliance review; and
• (l) comply with accurate shipping/customs declaration requirements.

Users may be private or commercial. No clause stating that all Users act “exclusively for private purposes” applies to commercial Users.

Termination

A User may terminate the U4F account in accordance with the account-deletion process, subject to completion of outstanding transactions, disputes, refunds, legal holds and record-retention obligations. Termination does not extinguish obligations arising from prior transactions or payment disputes. Mandatory data-protection rights remain unaffected.

Suspension, listing removal and remedial measures

U4F may reject or remove a listing; restrict buying, selling, payment or payout functionality; require additional verification; place an account under review; or suspend/terminate an account where reasonably necessary to:

• (a) enforce these Terms, Catalog Rules or Payment Provider Rules;
• (b) respond to a legal, regulatory, card-network, bank, carrier or payment-provider requirement;
• (c) investigate suspected fraud, identity theft, sanctions issues, money laundering, prohibited goods/services, adult/fetish activity, unsafe goods, counterfeit goods, misleading provenance, chargeback abuse or other harmful conduct;
• (d) address inaccurate, incomplete or outdated account information;
• (e) prevent circumvention of U4F fees or payment/moderation controls; or
• (f) protect Users, U4F, Stripe or other service providers from material risk.

Where Stripe or another payment provider informs U4F of a restriction, investigation or suspected violation, U4F may take corresponding account and transaction measures. U4F may provide Stripe with information reasonably required to investigate prohibited, illegal, fraudulent, deceptive or harmful activity and will cooperate with Stripe to reduce misuse of the payment services.

Notice and an opportunity to respond will be provided where required by applicable law and where doing so would not undermine fraud prevention, investigations, legal obligations or safety.

Dispute resolution

Where applicable to commercial users, U4F may participate in lawful out-of-court dispute-resolution procedures. This clause does not affect any mandatory consumer dispute-resolution information or jurisdiction rules that apply.

Data protection

U4F processes personal data in accordance with applicable data-protection law and the Privacy Policy. Users acknowledge that information may be shared with Stripe, banks, payment methods, fraud-prevention providers, identity-verification providers, carriers and other service providers where necessary to provide the marketplace, process payments, verify identity, prevent fraud, fulfil orders, handle disputes and comply with law. The STAR authorizes U4F to share Connected Account data with Stripe and to perform the payment-related activity described in these Terms, subject to the applicable Stripe agreement and data-protection requirements.

Final provisions

Austrian law applies to the extent legally permitted, without depriving consumers of mandatory protections that apply under the law of their habitual residence where such protections cannot be waived. Jurisdiction clauses apply only to the extent permitted by mandatory law. If a provision is invalid or unenforceable, the remaining provisions remain effective and the invalid provision is replaced only to the extent legally permissible. Electronic communications satisfy any written-form requirement to the extent permitted by law.
